1. The directors, owners, employees, agents, officers and representatives of Clear Credit Solutions do not provide financial or legal advice.

2. Upon the provider CCS accepting your application, CCS may provide you with a copy of your credit file, CCS will fill out online investigation Equifax forms for follow up calls with Equifax, Creditors, Ombudsman Services, Courthouses, ETC. CCS does not provide any other services than mentioned, clients could do all of these services for free if they know the correct procedure, they are willing to take the time and are aware of the relevant legislation.

3. CCS may charge up to one thousand nine hundred and eighty dollars which includes GST. CCS may give information to help you through the credit repair process via phone calls as necessary. If a resolution is not reached which removes a default the no win no fee conditions apply. 

No Win No Fee Conditions

It is in CCS best interest to investigate every possibility to ensure the default is removed which may involve ombudsman services CCS will administrate. To clarify – Either the default/adverse listing is removed and/or Clear Credit Solutions P/L obtains a resolution which includes the removal of the default as part of a payment arrangement, noting that simply paying an overdue account is not grounds to have a default removed.  If this fails the client will be receiving a full refund of our one set fee.

Truthful Disclosure

Clear Credit Solutions conducts its case assessments prior to accepting a client based on information provided by the client throughout the initial interview process. If it is discovered that a client has misinformed Clear Credit Solutions either directly or through the omission/non-disclosure of critical information, Clear Credit Solutions may choose to void its No Win No Fee Guarantee at its own discretion.

Opt-Out Policy

In order a client to qualify for Clear Credit Solutions No Win No Fee Guarantee, the client must allow Clear Credit Solutions to explore all avenues to attempt the removal of the negative information. If a client does not allow Clear Credit Solutions the opportunity to do this, Clear Credit Solutions may void its No Win No Fee Guarantee. A client may ‘opt-out’ or cease service as they wish but this does not qualify under the No Win No Fee Guarantee.

Issue of Refund

Clear Credit Solutions may offer the refund of an unsuccessful clients matter in one full payment to the clients nominated bank account or it may split the refund payments over a period no longer than 6 weekly installments completely at its own discretion.

Communication & Deadlines

In some instances, we may request that correspondence with a creditor or Ombudsman goes through your email address directly. If so, Clear Credit Solutions will supply draft responses for you to copy and send on. If correspondence is going through your email address and includes a deadline for reply and you fail to forward that on to Clear Credit Solutions within the allotted timeframe, or you voluntarily choose for a case to be closed, Clear Credit Solutions may choose to void your No Win No Fee Guarantee at its discretion.

4. The service that Clear Credit Solutions provides is the provision of information and advice about an individual’s credit status and steps that may be taken to identify if reports have been correctly reported and recorded and action that may be taken to remove incorrectly reported entries. Clear Credit Solutions does not provide any guarantee or assurance in relation to the removal of any and/or all reports from a person’s credit report. CCS know part 9, part 10 and bankrupt clients have no success, and we do not take these clients on as part of the above services mentioned. CCS will provide suggested legislation via the Privacy Act of 1988 along with The Credit Reporting Code of Conduct.
5. Should you authorise Clear Credit Solutions to act as your agent in relation to your credit information you consent to Clear Credit Solutions sending written correspondence to credit reporting agencies, credit providers and financial institutions on your behalf. Clear Credit Solutions may act as your agent in attempting to rectify purportedly inaccurate credit information, however, Clear Credit Solutions does not guarantee any amendment to your credit information. Should Clear Credit Solutions be unable to amend or modify your credit information Clear Credit Solutions accepts no responsibility and will not be held liable for any resulting damages.
6. Clear Credit Solutions advises that you have the right to query and contest inaccurate personal credit information through contacting relevant credit providers, credit reporting agencies and financial institutions. Clear Credit Solutions and the directors, owners, employees, agents, officers and representatives of Clear Credit Solutions do not have the right to remove accurate, fair or verifiable information from your credit report.
7. Clear Credit Solutions advises you of your right to acquire your personal credit report from a credit provider or credit report agency. In obtaining your personal credit report from a credit provider or credit reporting agency you may be charged a fee. CCS may charge a fee of up to One Thousand Nine Hundred and Eighty Dollars inclusive of GST.
8. Clear Credit Solutions advises you of your ability to personally notify or dispute inaccurate personal credit information held by a credit agency, credit provider or financial institution in writing. As a result of written correspondence to the credit agency, credit provider or financial institution which disputes your credit information your credit report is expected to be reviewed and, if necessary, modified to amend any inaccurate information.

While information on the Clear Credit Solutions site attempts to explain aspects of the law the information is not legal advice and is provided to enable you to understand the services of Clear Credit Solutions Pty Ltd. Clear Credit Solutions and the Clear Credit Solutions’ site does not provide legal advice. Clear Credit Solutions recommends you obtain professional legal advice prior to any financial decision or conduct that may result in financial risk.
10. Clear Credit Solutions Pty Ltd, the Clear Credit Solutions website and the services provided by Clear Credit Solutions is protected collectively under Australian copyright law. All information, services and materials provided on the Clear Credit Solutions site is owned by Clear Credit Solutions Pty Ltd. Any person or entity who uses the Clear Credit Solutions’ site is prohibited to distribute, replicate, modify, republish, copy or store for commercial purposes any materials, information or services of Clear Credit Solutions other than under the written consent of Clear Credit Solutions Pty Ltd.
11. Clear Credit Solutions and the directors, owners, employees, agents, officers and representatives of Clear Credit Solutions will not be held liable for any direct or indirect damages incurred as a result of this site including but not limited to contractual responsibilities, any loss of profits or income or any tort.
12. The submission of your personal details to Clear Credit Solutions representatives authorises Clear Credit Solutions to act as your agent in relation to your credit information and you consent to Clear Credit Solutions to obtain copy of your credit reporting information in accordance with Part IIIA of the Privacy Act 1988 as applicable. Should your credit information be in the control or possession of a credit provider, credit reporting agency or other financial institution Clear Credit Solutions Pty Ltd, acting as your authorised agent, may exercise your right to retrieve your credit information without further notice to you.
13. Clear Credit Solutions may collect your personal information for the purpose of providing you with your elected credit review services. By submitting your personal information to the Clear Credit Solutions site you acknowledge and agree that Clear Credit Solutions may disclose your personal information as required to other organisations that assist Clear Credit Solutions in the provision of your elected credit review services and you will be charged up to one thousand nine hundred and eighty dollars (inc gst).
